A contractor asks to change a specified material for an equivalent. Sometimes that is good engineering and sometimes it is margin recovery. How to tell.
Substitution requests arrive throughout a build: a different tile, a different membrane, another manufacturer of switchgear. Some are genuinely driven by availability or lead time, some improve the building, and some exist to recover margin on a low tender. The decision is manageable if you separate the reason for the request from the performance of the product.
Approve the substitution at a glance
Accept an alternative product on the basis that it meets the specified performance, with the technical comparison documented and any cost difference credited or agreed. Approval is given in writing, references the specification clause, and states the basis on which the item was judged equivalent.
Insist on the specification at a glance
Require the specified item, on the basis that it was priced in the contract and was chosen for reasons the contractor may not be aware of, such as compatibility, warranty, maintenance or appearance consistency with other elements.
What triggered the request
Approve the substitution: Availability, lead time or a documented technical problem with the specified item.
Insist on the specification: A request with no stated reason, or one that appears only after the contract was signed at a low price.
Evidence offered
Approve the substitution: A clause by clause comparison against the specification with test data and certificates.
Insist on the specification: A brochure and an assurance that the product is the same or better.
Effect on warranties
Approve the substitution: Neutral, where the alternative carries equivalent warranty terms from a supported supplier.
Insist on the specification: Damaging, where the item is part of a system whose warranty depends on specified components.
Effect on cost
Approve the substitution: A credit passed to the owner where the alternative is cheaper, agreed before approval.
Insist on the specification: No credit offered, which tells you what the request is actually about.
Effect on maintenance
Approve the substitution: Equivalent or better local support, spares and service availability.
Insist on the specification: A product with no local agent, which becomes your problem for the life of the building.
Who carries the risk after approval
Approve the substitution: Shared, and an approval letter should say explicitly that the contractor remains responsible for performance.
Insist on the specification: Clear, since insisting on the specification leaves the original allocation of risk untouched.
When approve the substitution wins
- The specified item has a lead time that would delay a critical activity.
- The alternative genuinely performs better in local conditions such as heat or dust.
- The specified product is no longer available or not supported locally for maintenance.
- A credit is available and the difference in performance is immaterial to you.
When insist on the specification wins
- The item is part of a warranted system where mixing products voids the warranty.
- Appearance consistency matters, such as facade panels or visible ironmongery.
- Maintenance and spares support in the Kingdom was the reason for the original choice.
- The request arrives late and no credit is offered, which suggests margin rather than necessity.
How to decide
Judge every request against the performance requirement in the specification, not against the brand name. Approve where the alternative meets the requirement, the comparison is documented, any saving is credited and the warranty position is unaffected. Refuse where the item belongs to a warranted system, where appearance consistency matters, or where no credit accompanies a cheaper product. When approving, state in writing that the contractor remains responsible for the performance of the substituted item, since an owner approval is otherwise used later as an argument that you chose it.
Require a substitution request in a fixed format: the specified item, the proposed item, a clause by clause comparison, test certificates or conformity evidence, lead time, local support arrangements, warranty terms and the cost difference. A request that cannot be made in that format is not ready to be decided. Keep every approved substitution in a register, because at handover the register is what tells you and any future buyer what the building actually contains.

Frequently Asked Questions
What does approved equal mean in a construction specification?
It means the specification names a product to set a standard and allows an alternative that meets the same performance, subject to approval. The phrase shifts the burden onto the contractor to demonstrate equivalence, which is why the request should arrive with a clause by clause comparison rather than a brochure. Without that comparison, approved equal becomes whatever the contractor can buy cheaply.
Should a contractor pass on the saving from a cheaper substituted material?
On a lump sum contract the position depends on the wording, but as a matter of negotiation the answer is that a substitution requested by the contractor for their own convenience should carry a credit. If the substitution is requested because the specified item is unavailable through no fault of theirs, the cost position is more evenly balanced. Either way, settle the money before approving rather than afterwards.
Do imported materials need conformity approval in Saudi Arabia?
Many product categories are subject to conformity requirements administered through SASO and the SABER platform, and the applicable requirements depend on the product. Because scope and procedures change, confirm the current position for each item with the relevant authority or a customs agent before ordering, and make conformity evidence a condition of the substitution approval rather than something checked at the port.
